What are the conditions for marriage?
According to Article 6 of the Revised Family Law of the Federal Democratic Republic of Ethiopia, a valid marriage is considered valid only when the spouses give their free and full consent to marry.
Article 7 (1) - Neither the man nor the woman can get married before they turn 18 years old.
Article 7 (2) - Notwithstanding the provisions of subsection (1) of this article, in case of serious reasons, upon the request of the spouses or the parents or guardians of one of the spouses, the Minister of Justice may allow the marriage to be reduced by not more than two years from the normal marriage age.
Article 8 (1) - Marriage between direct blood relatives (parents and descendants) is prohibited.
Article 8 (2) - It is forbidden for a man to marry his sister or his aunt, and a woman to marry her brother or her uncle, in case of physical relationship that is considered to be on the side.
Article 9 (1) - Marriage between direct relatives is prohibited.
Article 9 (2) - It is forbidden for a husband to marry his wife's sister or a wife to her husband's brother in cases of marital relations that are considered to be aside.
Article 26 (1) - According to the religious system, marriage can be performed and the procedure for performing it depends on the religion.
Article 26 (2) - The conditions that must be met for the performance of any marriage in this law must also be met for a marriage performed according to religious order.
Article 27 (1) - The place where marriage can be performed and the procedure for performing it is determined by the local culture.
Article 27 (2) - The conditions that must be fulfilled for the performance of marriage in this law must also be fulfilled for a marriage performed according to the traditional system.
ጋብቻ ለመፈጸም መሟላት ያለባቸው ሁኔታዎች ምንድን ናቸው?
በኢትዮጵያ ፌዴራላዊ ዴሞክራሲያዊ ሪፐብሊክ የተሻሻለው የቤተሰብ ሕግ አንቀጽ 6 መሰረት የሚጸና ጋብቻ ተፈጸመ የሚባለው ተጋቢዎቹ ለመጋባት ነፃና ሙሉ ፍቃዳቸውን ሲሰጡ ብቻ ነው፡፡
አንቀጽ 7 (1) - ወንዱም ሆነ ሴቷ 18 ዓመት ሳይሞላቸው ጋብቻ መፈጸም አይችሉም፡፡
አንቀጽ 7 (2) - በዚህ አንቀጽ ንዑስ አንቀጽ (1) የተደነገገው ቢኖርም ከባድ ምክንያት ሲያጋጥም ተጋቢዎቹ ወይም ከተጋቢዎቹ የአንዳቸው ወላጆች ወይም አሳዳሪ በሚያቀርቡት ጥያቄ መሰረት የፍትሕ ሚኒስትሩ ከመደበኛው የጋብቻ እድሜ ከሁለት ዓመት ያልበለጠ ጊዜ በመቀነስ እንዲጋቡ ሊፈቅድ ይችላል፡፡
አንቀጽ 8 (1) - በቀጥታ የሥጋ ዘመዳሞች (በወላጆችና በተወላጆች) መካከል ጋብቻ መፈጸም ክልክል ነው፡፡
አንቀጽ 8 (2) - ወደ ጎን በሚቆጠር የሥጋ ዝምድና አንድ ወንድ ከእህቱ ወይም ከአክስቱ፣ እንዲሁም አንዲት ሴት ከወንድሟ ወይም ከአጎቷ ጋር ጋብቻ መፈጸም የተከለከለ ነው፡፡
አንቀጽ 9 (1) - በቀጥታ የጋብቻ ዘመዳሞች መካከል ጋብቻ መፈጸም ክልክል ነው፡፡
አንቀጽ 9 (2) - ወደ ጎን በሚቆጠር የጋብቻ ዝምድና፣ ባል ከሚስቱ እህት ወይም ሚስት ከባሏ ወንድም ጋር ጋብቻ መፈጸም ክልክል ነው፡፡
አንቀጽ 26 (1) - በሃይማኖት ስርዓት መሰረት ጋብቻ ሊፈጸም የሚችልበትና የአፈጻጸሙ ስርዓት እንደየሃይማኖቱ ይወሰናል፡፡
አንቀጽ 26 (2) - በዚህ ሕግ ለማንኛው የጋብቻ አፈጻጸም መሟላት አለባቸው የተባሉት ሁኔታዎች በሃይማኖት ስርዓት መሰረት ለሚፈጸም ጋብቻም መሟላት አለባቸው፡፡
አንቀጽ 27 (1) - በባህል ስርዓት ጋብቻ ሊፈጸም የሚችልበትና የአፈጻጸሙ ስርዓት በአካባቢው ባህል ይወሰናል፡፡
አንቀጽ 27 (2) - በዚህ ሕግ ለጋብቻ አፈጻጸም መሟላት አለባቸው የተባሉት ሁኔታዎች በባህል ስርዓት ለሚፈጸም ጋብቻም መሟላት አለባቸው፡፡
